General Sales Terms
ORDERS AND DELIVERIES
ORDER FORMALIZATION
- The general sales terms of Weelko Barcelona S.L. are tacitly accepted by the Distributor when placing the order and accepting the quotation.
- The Distributor shall submit their order request in writing. Weelko Barcelona S.L. will inform the Distributor of the availability of the products, the delivery time, and issue the corresponding quotation.
- The order will be effective once 100% of the accepted offer payment is received by bank transfer.
- For reservations on special products or products that are out of stock, Weelko may request an advance payment of 30% of the commercial offer via bank transfer. Once the product is available, the Manufacturer will inform the Distributor so that they can proceed with the payment of the remaining 70%, and then the merchandise will be shipped to the destination.
- Current promotions will be valid only until the established deadline or until stock runs out, except in case of a typographical error.
PRICES
- The prices indicated in the price lists and on the website do not include VAT or shipping costs.
- Weelko Barcelona S.L. reserves the right to modify prices at any time, committing to maintaining the prices indicated in the current offers, except in the case of a typographical error.
PRODUCT DELIVERY AND TRANSPORT
- The merchandise is considered sold Franco Fábrica in Berga (Barcelona). The merchandise always travels at the Distributor's risk and expense, even if Weelko Barcelona S.L. manages the shipping. Weelko Barcelona S.L. is not responsible for any losses, damages, or incidents that may occur in relation to transport.
- The Distributor must provide all necessary details to ensure proper dispatch and ensure a good service.
- To process any claim to Weelko Barcelona S.L. regarding transport, such as damage, non-conformity with received material, omissions, or errors in the order, the recipient must note it on the transporter's delivery note with the note "Accepted with reservations". If the product or packaging is visibly damaged, explicitly state "Damaged package" on the transporter's delivery note and immediately inform Weelko Barcelona S.L. to file the claim within the first 24 hours. In both cases, the Distributor has 24 hours to inform Weelko Barcelona S.L. to proceed with the claim. Weelko Barcelona S.L. will not be responsible for transport damage after the first 24 hours or if the Distributor does not note it on the delivery note.
- Delivery delays do not entitle the Distributor to cancel the order and reject the merchandise.
- Weelko Barcelona S.L. reserves the right to split the order into multiple shipments, without additional cost to the customer.
WARRANTY
- Weelko Barcelona S.L. guarantees the material against manufacturing defects for a period of 12 months from the date of purchase. The invoice issued by Weelko Barcelona S.L. serves as the warranty certificate, and must be kept.
- The resolution of issues arising within or outside the warranty period is the responsibility of the Distributor, who will have the Manufacturer's collaboration to resolve them, as much as possible, without needing to return the material to Weelko.
- The Distributor must send a detailed report of the issue to the Manufacturer to detect the cause of the malfunction. Once the cause is detected, the necessary part for the repair will be indicated to the Manufacturer. If the product is under warranty, the Manufacturer will provide the necessary replacement part at no cost. Shipping costs will be borne by the Distributor or can be included in a future order from the Distributor.
- If the Distributor cannot detect the issue with the Manufacturer's help, the Distributor must send the faulty material to the Manufacturer for inspection and repair. Shipping costs will be borne by the Distributor.
- In any case, the warranty applies from Weelko's facilities in Berga (Barcelona), and the Distributor must cover the shipping costs.
- After the warranty period, the Distributor must cover the cost of parts, repair labor, and shipping.
- Under no circumstances will the Manufacturer contact the Distributor's end customer.
- Defects or damage caused by misuse, poor unpacking, negligence, accidents, or natural wear of the product are excluded from the warranty.
- The Manufacturer does not guarantee the cleaning of stains caused by chemical or acidic substances.
- The warranty will be automatically void if malfunctions occur due to unauthorized internal handling.
- No material will be accepted for return unless expressly authorized and in writing by Weelko Barcelona S.L. to the purchasing company.
- Products eligible for a refund must be returned to Weelko Barcelona at the Distributor's expense within 15 days of receipt. No refund will be issued for material that is not returned with prior notice, in perfect condition, and in its original packaging. Once the products are received at Weelko's facilities in Berga and everything is in order, Weelko Barcelona S.L. will issue the corresponding refund.
- The repair or replacement of a defective item does not affect the warranty of the set. The replaced part will have a 12-month warranty starting from the repair or replacement date.
- Weelko Barcelona S.L. is not responsible for upholstery performed at the customer's request. Weelko Barcelona S.L. guarantees only the quality of the upholstery finishes provided by the manufacturer. Any alteration of the product by the Distributor is the Distributor's responsibility, and the warranty terms will not apply to anything that may arise from such modifications.
DROPSHIPPING SALES
- According to the warranty conditions mentioned above, distributors working in the DROPSHIPPING model should note that Weelko's warranty for malfunction resolution applies from Weelko's facilities in Berga (Barcelona). With Weelko's collaboration, the cause of the malfunction will be detected to avoid returns by the Distributor, and Weelko will send the necessary part at no cost, with the Distributor covering shipping costs. If the goods need to be returned to Weelko for repair or replacement, the Distributor will bear the return shipping costs.
RULES AND COMPETENT COURT
- Any special sales conditions agreed between the seller and the buyer, and in derogation of the above general conditions, will only modify the additions or observations mentioned in the respective agreements. The other points of these general sales conditions will apply.
- Any agreements made between the seller and the buyer that differ from these general sales conditions will be valid and binding only if they are written down.
- These conditions will be governed by and interpreted in accordance with Spanish laws. In case of possible disputes, both parties submit to the jurisdiction and competence of the Courts and Tribunals of Berga (Barcelona).
GENERAL INFORMATION
- To clean skay or PU coatings, no specific procedure is required. Normal dirt can be cleaned simply with a damp cloth (not wet). Dry foam cleaners available in the market can also be used. Do not use abrasive detergents or solvents. Manufacturers do not guarantee the cleaning of stains caused by chemical or acidic substances.
- Weelko Barcelona S.L. is not responsible for upholstery performed at the customer's request. Weelko Barcelona S.L. guarantees only the quality of the upholstery finishes provided by the manufacturer. Any alteration of the product by the buyer is their responsibility, and the warranty terms will not apply to anything that may arise from such modifications.
- Wood pieces may show color variations due to natural factors of the material (grain, drying, aging, etc.).
- The colors in the catalog illustrations should be considered as indicative and are not contractual.
